The practice

The Litigation Practice at EPAM is one of the largest and most experienced teams in the Russian legal market. For more than 30 years, our lawyers have successfully handled landmark disputes involving clients’ key assets, corporate control, strategic obligations, business reputation and overall business resilience.

We represent leading Russian and international companies in disputes of any complexity, including sophisticated cross-border proceedings where success depends on a carefully calibrated strategy and seamless coordination.

Each year, the team handles more than 100 litigation and arbitration matters, many of which are precedent-setting or shape judicial practice.

Our team has extensive experience representing clients before the Constitutional Court, the Supreme Court and courts throughout the Russian Federation, as well as before arbitral institutions. We also represent clients before patent, customs and antitrust authorities, and in subsequent litigation involving public authorities.

Alongside litigation, we use alternative dispute resolution mechanisms, including mediation. Our team includes professional mediators who provide comprehensive support throughout negotiations and help develop mutually beneficial settlement terms.

For major projects, we form multidisciplinary teams, bringing together lawyers from more than 20 of the firm’s practice areas and acting as a one-stop shop for our clients.

Our dispute resolution expertise is recognised in Russia and internationally. Projects
  • Defending the interests of AB InBev Efes Brewery in a significant FMCG market-wide dispute worth over RUB 730m. The dispute arose in connection with an attempt to unreasonably recover from the client "under-received discounts" and "incentive payments" provided by the distributor to retail outlets and could have affected the entire distribution market. ("Dispute of the Year" according to Kommersant 2022, 2023).
  • Representing a subsidiary of Surgutneftegas, one of Russia’s largest oil companies, in the high-profile insolvency of a fuel card operator. The team acted for the client in numerous disputes, including before the Supreme Court’s Judicial Chamber for Economic Disputes, where it secured the reversal of all previous judgments invalidating fuel supply transactions.  ("Dispute of the Year" according to Kommersant 2023).
  • Successfully representing Novartis, an international pharmaceutical corporation, and other Big Pharma companies in high-profile cases concerning unfair practices by a distributor of a generic drug manufactured in breach of patent rights. The matter was recognised by Kommersant as one of the most significant antitrust disputes of 2022.
  • Developing a defence strategy and representing IMC Montan in court proceedings brought by a commercial bank for USD 140 million. The case was a unique attempt to recover losses allegedly caused by an external consultant. ("Dispute of the Year" according to Kommersant 2021).
  • Defending BlaBlaCar, the world’s leading long-distance carpooling platform, in court proceedings brought by a group of carriers seeking to ban the service in Russia and have information on the BlaBlaCar platform declared prohibited for distribution.
  • Successfully defending Yandex, Russia’s largest technology company, in court proceedings against Google concerning Google’s anti-competitive conduct in the market for pre-installed app stores on Android devices.
  • Defending LabQuest Technology JSC, a shareholder in a major medical laboratory services provider, in a landmark corporate conflict.
  • Defending ZMK 1520 LLC in an unprecedented dispute with New Forwarding Company JSC concerning the recovery of losses in the form of overpayments for railcars. The team secured a settlement of the dispute.
