EPAM Successfully Defend Interests of Cherkizovsky Meat Processing Plant in Dispute With Miratorg

EPAM has acted on behalf of the Cherkizovsky Meat Processing Plant in a dispute with its competitor Miratorg. Cherkizovsky Meat Processing Plant is a well-known manufacturer of processed meat products in Russia and part of the Cherkizovo Group, one of Russia’s largest agribusiness holding companies.

Miratorg had accused Cherkizovsky Meat Processing Plant of copying its packaging for roasting meat, which gave grounds for the Federal Antimonopoly Service to launch and investigate a case of unfair competition with respect to the company.

The Firm’s legal team was able to mount an effective defence, proving that the most important consideration when choosing meat for roasting is the name of the manufacturer, and that due to the wide recognition of the Cherkizovo brand and its styling, consumers are able to distinguish the company’s roasting meat from similar Miratorg products. Consequently, there is no risk of consumers being misled or of any confusion being created on the market.

As a result, the Federal Antimonopoly Service dropped the case against Cherkizovsky Meat Processing Plant on the grounds that no breach of competition law had been committed.
