One of the oldest alcohol factories in Russia, producer of the "Arkhangelskaya" vodka, faced an attempt by a competitor to launch a product with a similar design — "Altayskaya Vеrshina" vodka. The labels of the new product were registered by the opponent as trademarks in their own name.
Before approaching the Firm, the client considered various options for invalidating the opponent’s trademarks. The Intellectual Property / TMT Practice lawyers developed and successfully implemented a strategy to submit an appeal to the Rospatent Patent Disputes Chamber. Rospatent fully supported the position and agreed with all the arguments presented by the Firm’s lawyers: the opponent’s trademarks were annulled, and during the review of four cases, the broad recognition of the client’s trademarks was confirmed.
The decisions of Rospatent were not appealed to the Court of Intellectual Property.
