Valery Eremenko attends a round table discussion entitled "Grounds for Liability of the Head of a Legal Entity"
On March 25, 2013 a round table discussion entitled “Grounds for Liability of the Head of a Legal Entity” was held in Moscow by M-Logos Legal Institute supported by Infotropic Media Publishing. Valery Eremenko, Partner at EPAM, attended the event.
The discussion covered the following issues:
- To what extent is the application of the guilt criterion to directors’ responsibility justified? What do criteria of reasonableness and good faith mean in substance?
- Would it be reasonable to introduce the presumption of directors’ innocence considering that the Civil Code norms as related to the contractual and delictual responsibility considering that the Civil Code norms provide for the contrary? What political and legal grounds may justify such a decision?
- Distribution of the burden of proof and introduction of counterpresumptions.
