Pavel Sadovsky to attend the 13th Practical Conference on Intellectual Property
The 13th Practical Conference on Intellectual Property, organised by infor-media Russia, will be held on March 20 and 21, 2013 in Moscow. Pavel Sadovsky, the leader of IP / TMT department at EPAM, will attend the event.
Many manufacturers have recently faced serious issues such as the use of well-known Soviet brands. Technically the legislation in force grants the right of these brands only to those manufacturers who were the first to register the brands as trademarks. This approach has been widely criticised and has resulted in huge amounts of compensation being recovered from the traditional manufacturers. This action may also obstruct free movement of goods within the Customs Union and infringe upon interests of the other CU states.
The use of well-known Soviet brands will to be discussed at the conference, as part of a particular business case involving Pavel Sadovsky and Elena Kushnareva of ORKLA Brands Russia.
The presentation will cover the following topics:
- key issues of the judicial practice;
- need to amend the current regulation;
- restoration of the right of prior use as a main remedy for the problem;
- alternative remedies.
