By its decision issued on 29 September 2014 the Vologda Region Arbitrazh Court has fully dismissed the opponent’s claim to invalidate the Russian utility model patent held by ZAO Ultracraft. The utility model refers to the innovative technology for ultrasonic testing of steel structures used for high-tech equipment supplied by the client to Germany, Japan, etc.
The EPAM attorneys had earlier managed to have the Rospatent’s decision to revoke the client’s patent cancelled in the Intellectual Property Court (the IP Court), which was a landmark decision for the IP Court as far as it was the first time the Court reviewed and pointed that it was inacceptable for the Chamber for Patent Disputes to accept copies of written evidence that do not comply with the validity criterion.
