On 27 November 2014 a business discussion was held at the Firm’s St. Petersburg office regarding recent amendments to the law on valuation and their impact on how the cadastral value of real estate can be challenged. The speakers were associates at the Firm.

Olga Mischenko, Head of Construction and PPP Practice, opened the discussion. In her talk, Mischenko outlined new legal aspects related to challenging cadastral value, safeguarding measures applicable when challenging the cadastral value of buildings undergoing construction, the frequency of government cadastral valuations, the use of the new value for tax purposes and challenging the cadastral value of buildings undergoing construction.

The topic was continued by the Firm’s Associate Yury Nefedov, who spoke on the features of the preliminary stage of challenges to cadastral value and the review of disputes by the Arbitration Commission. Nefedov illustrated his talk with statistical data taken from cases considered by the Arbitration Commission in St. Petersburg over the past year.

The final presentation was given by Sergey Korolev, Senior Associate in the Litigation Practice. His talk focused on the judicial aspects of challenges to cadastral valuation. In particular, Korolev undertook to explain in detail the issues surrounding jurisdiction and cognisance in disputes regarding cadastral valuation, as well as the necessity for expert analysis.

Contributing to the discussion as an independent expert was Alexander Filippov, director of NAI Becar’s valuation department in St. Petersburg.

The event concluded with a lively discussion between the speakers and guests. Attendees also had the chance to ask the speakers questions.
