The Litigation Practice team of EPAM defended the interests of Ecosoyuz LLC in the Chamber on Economic Disputes of the Russian Supreme Court in a dispute under the contract of vessel chartering.

The Firm’s lawyers drafted a cassation appeal against the judicial acts refusing to meet the requirements of Ecosoyuz claims to recover the rent cost in the amount of more than 122 million RUB for winter storage of floating crane required for cargo handling at the port of Sabetta, on the Yamal Peninsula.

Loss of use of the vessel during the winter navigation period has occurred as a result of misconduct by the charterer: delayed return of the crane, non-compliance with the its operation rules and ignoring the climatic conditions of the area of use.

Upon review of the appeal, the case was referred to the Judicial Chamber of the Russian Supreme Court, which cancelled all the previous judicial decisions and sent the case for retrial.
