On September 14, 2010 Moscow hosted a conference on Cross-Border Dispute Resolution: The Perspective for Russia and the CIS organized by the American Bar Association (ABA). EPAM was the strategic partner of the event.
During the conference the participants held discussions on particulars of representing international firms in judicial and arbitration proceedings involving Russian state-run and private companies, the experience of Russian companies in international courts and arbitration tribunals and recent changes in the Russian judiciary.
The key topics for discussions were: Judicial Assistance and Enforcement Proceedings; International Asset Recovery; Business and Corporate Raiding; Disputes Involving Russian State and State Entities.
Ilya Nikiforov, managing partner of EPAM chaired the session entitled Show Me the Money: Recovering Assets Abroad. An unstable financial and economic climate has resulted in an increasing number of companies, particularly in Eastern Europe, disobeying the court judgments on property claims, or concealing their assets from creditors. The panel members discussed ways of overcoming legal barriers when recovering the overseas assets, for example, in offshore jurisdictions. During the sessions Russian and international experts made immediate and efficient recommendations on detecting and prosecuting ultimate beneficiaries of trusts and other offshore funds, and on preventing the use of other tools in this area.
