EPAM has successfully defended the interests of OJSC Transammiak in a dispute with the largest fertilizers manufacturer OJSC Minudobreniya which initiated multiple compulsions to transport additional volumes of liquid ammonia.
In the course of the latest proceedings the fertilizers manufacturer insisted on entering into a new agreement providing for increase of the delivery volumes along with a considerable price reduction.
The Firm’s lawyers managed to prove that this claim could not be satisfied due to a limited transmission capacity of the ammonia pipeline and a less than fair agreement price. Minudobreniya applied to the Samara Court that satisfied the claimant’s demands.
On October 22, 2013 the judgment of the Samara Court was invalidated and the claimant’s terms were declared unprofitable. Thus the judgment of the Samara Court to satisfy the claims of Minudobreniya was cancelled in full.
Transammiak was represented by the joint team of Competition and Litigation practices of EPAM: Partners Natalia Korosteleva and Valery Eremenko and Senior Associate Maria Kobanenko.
