In keeping with tradition, the Criminal Law Practice team at EPAM Law presents its review of legislative trends over the past year.
The Criminal Code and the Criminal Procedure Code remain among the most frequently amended laws in the country, making it challenging to navigate the constant changes. In the past year alone, the Criminal Code saw 21 amendments and the Criminal Procedure Code 17 amendments.
On the whole, these changes keep pace with current realities and address pressing issues of the day, such as replenishing the state budget, combating illegal migration, and other matters.
The legislator has also taken into account the current level of inflation, increasing the minimum thresholds of damage required to initiate proceedings in a number of economic crime cases.
Accordingly, the most significant developments for businesses include:
- an average 50% increase in minimum thresholds for criminal liability in “economic” offences;
- tougher liability for anti-competitive conduct;
- the introduction of new criminal offences relating to taxation and personal data circulation;
- increased liability for organising illegal migration;
- the introduction of a mechanism for exemption from criminal liability in connection with participation in the Special Military Operation (SMO).
