EPAM advised on the Russian aspects of the USD550m acquisition of Tensar – a portfolio company of Castle Harlan Inc.'s funds, and the world-leader in the manufacture and supply of retaining walls, ground stabilisation and soil reinforcement solutions across 80 national markets – by Commercial Metals Company, US steel and metal manufacturer. The transaction was multi-jurisdictional and included Tensar companies in the US, Europe, China, Russia.

The Arbitration Centre at the Russian Union of Industrialists and Entrepreneurs (RSPP) has established a Board for intellectual property disputes. The President of the RSPP has approved the Board’s arbitrators - recognized scientists and practitioners of the intellectual property market, many of whom have been directly involved in creating the basis for the regulation of IP in Russia. Helen Avakyan, Counsel at EPAM, was appointed as the Chairman of the Board. Pavel Sadovsky, Partner and Head of Intellectual Property / TMT Practice was appointed as an arbitrator of the Board.

Until recently, Aqua Investments Group, a client of the Firm, in cooperation with Kavminkurortresursy JSC, had successfully protected their exclusive geographical indication (GI) rights to the products Yessentuki N4 and Yessentuki N17 (GI Yessentuki). In most cases, the holder of the GI rights had managed to prevent competitors from launching counterfeit products attempting to use the well-known healing diets and mineralized healing water brands.

The national pharmaceutical chain VITA / VITA Express, which has been operating in Russia since 1995 and numbers 1,730 pharmacies, engaged the Firm’s services after it became known that a competitor was also using a logo containing the word “ВИТА” (the Russian word for VITA) and a similar colour combination on its signs. Moreover, VITA’s opponent managed to register its logo as a trademark with Rospatent. Protecting the client’s interests proved to be challenging as the logo used by the client was different from the one protected by their trademark.
