Pavel Sukholinskiy and Pavel Baryshnikov Discuss Draft Russian Procedural Code of Administrative Offenses

On September 6, 2021, Counsel Pavel Sukholinskiy and Associate Pavel Baryshnikov, attorneys at EPAM’ Administrative Law Practice, discussed the draft Procedural Code of Administrative Offenses at the Russian Presidential Commissioner for Entrepreneurs’ Rights expert center.

The Russian Ministry of Justice has been developing a new Code of Administrative Offenses and Procedural Code of Administrative Offenses for many years now and has engaged major business associations and the Russian Presidential Commissioner for Entrepreneurs’ Rights to assist in the matter.

The draft Procedural Code of Administrative Offenses shall expand the scope of the application of electronic technologies and the list of cases, where fines may be paid at 50%, and provide for the potential to enter into agreements with the Bank of Russia. Other novelties include setting the procedure for the restoration of rights for those held illegally responsible.

The attendees of the discussion addressed the provisions of the draft Procedural Code of Administrative Offenses and developed guidelines on how to amend the draft to protect the rights of entrepreneurs and other parties engaged.
